ordering, the customer is assumed to have read and to have
understood the following terms and conditions!
While
we try to maintain our website with “real time” inventory
quantities, there will be occasions when a sale or pending
sale affects the actual number of bottles on hand. Therefore,
we make no guarantees regarding the availability of any
particular wine at a particular time. We ask that customers
please e-mail or call us to guarantee that we have in stock
the wines you want.
While
we do not expect to have any pricing errors, we must state
that prices are subject to change without notice. We reserve
the right to correct pricing errors.
In our “Rare & Limited” section,
we make every effort to assure that the wines are in top
condition for their age, and we do not accept questionable
goods. For
Rare & Limited
wines, it is the industry standard that such wines are
purchased at the buyer's risk in case of a problem.
All
information, documents, images, and HTML formatting are
copyrighted and may not be reused or copied without permission.
We pursue those individuals who use our proprietary information
for their purposes.
SHIPPING
POLICIES:
Please note, we expressly cannot ship to
the following States at this time:
Utah, Tennessee, Florida,
Kentucky
Wines
may be sold only to persons who are at least 21 years
of age.
By placing an order, you are warranting to us that you
are at least 21 years of age. Any order placed by someone
under 21 constitutes fraud.
Wines
may be delivered only to persons who are at least 21
years of age. Our shippers will require a signature of someone who
is at least 21 years of age at the time of delivery. Positive
ID may be required. If the wine is returned
to us for failure to provide positive proof of age, the
customer is responsible for paying the return shipping
charges.
All
orders will have insurance charges added. Weather damage
is not covered by this insurance.
We
can assume no liability for damage due to extreme weather
conditions. The best way to prevent
possible damage to your wines is to ship using priority
overnight. However, we are willing to hold your purchased
wines per your request until more favorable weather
conditions prevail if overnight shipping does not interest
you.
In any
event, VWM assumes no liability for wine damaged due to
poor weather during transport. This can include problems
from leakage or freezing. Please be sure of shipping conditions
before placing a shipping order. We try to be aware of
weather conditions of places we ship but cannot do so with
much accuracy due to the rapid changes possible with localized
weather conditions. We ask you to help us help you.
All
wine is sold in California, and title
passes to the buyer in California. We make no representation
relative to your right to import wines into your state
or county. The customer, by placing an order, warrants
to us that he/she is aware of and in compliance with
the laws governing said shipment into his/her area.
All
orders shipped outside of CA are not subject to CA state
sales tax. All orders held at our location for customer
pick-up will be charged California sales tax without exception!
If we failed to add sales taxes when the order was placed,
we reserve the right to correct and collect any sales taxes
due.
Customer
is solely responsible for shipment of wines. Unless you instruct us otherwise, you agree that we shall
arrange, on your behalf and responsibility, shipment
with a common carrier to make the delivery. We reserve
the right to determine the propriety of shipping instructions
and may refuse to ship if we deem it inappropriate or
unsafe. If shipment is returned for any reason other
than VWM's error, the customer must pay any additional
shipping required.
Shipping
is never “free”!!!
